What is the overtime rate under the Factories Act?
The Factories Act 1948 (Section 59) mandates double the ordinary rate of wages for overtime. Workers cannot be asked to work more than 10.5 hours/day or 60 hours/week.
Is overtime applicable to all employees?
Factories Act overtime applies to workers in factories. Office employees (under Shops & Establishments Act) have separate state-specific rules. Senior management may not be eligible for OT.
How is the overtime hourly rate calculated?
Hourly rate = (basic + DA) ÷ (working days × hours per day). Overtime is calculated on basic + DA, not on HRA or other allowances.
